1.Privacy information

The term “personally identifiable information,” within the category of privacy information, refers to “personal information” as set forth in Japan’s Act on the Protection of Personal Information. This term refers to information that can be used to identify a living individual, such as the individual’s full name, address, telephone number, contact information, or another descriptor.
“Records and personal data,” within the category of privacy information, refers to information other than the personally identifiable information defined above. This includes information such as purchased products, utilized services, website and advertisement viewing histories, and search terms, as well as date and time of use, method of use, environment of use, postal code, gender, occupation, age, place of employment, email address, IP address, cookie information, and device identification.

2.Collection of privacy information and purpose of use

2-1.Collection method

When you register to use the services of Darcy's Factory Co., Ltd. (hereinafter “the Company”), the Company may ask for personally identifiable information such as your name, address, telephone number, email address, password, shipping address, and credit card number. In addition, the Company may collect payment-related information and transaction records that include personally identifiable information from the Company's business partners (including but not limited to information providers, advertisers, and advertising distributors; hereinafter “Partners”).

When you use the services or browse the websites of the Company and Partners, the Company collects records and personal data about you, such as your purchased products, utilized services and software, website and advertisement viewing history, search keywords, date and time of use, method of use, environment of use (including but not limited to the method of data transmission used by your mobile device when using the Company's services and your device settings when using the Company's services), IP address, email address, cookie information, and device identification.

2-2.Purpose of use

The purposes for which the Company collects and uses personally identifiable information are limited to the following:

  • (1)To display registration information such as your name, address, contact information, and payment method, as well as information regarding your purchased products, utilized services, and prices thereof, such that you can view and modify your own registration information and view your usage status.
  • (2)To use your email address to send you notifications and messages and to use your contact information, such as your name and address, in order to send you products and, if necessary, to contact you.
  • (3)To use information such as your name, address, telephone number, credit card number, and the delivery status of certified mail deliveries in order to verify your identity.
  • (4)To use the name and quantity of your purchased products, the type, duration, and number of your utilized services, and payment information such as your billing amount, name, address, and credit card number in order to bill you for a purchase.
  • (5)To display information registered with the Company on an input screen to facilitate a process requiring the inputting of information and to forward said information to other services (including those provided by Partners) at your instruction.
  • (6)To use information for identifying individuals, such as usage patterns, names, and addresses, in order to refuse the use of our services to customers who have violated our Terms of Service, such as those who delay payment, cause injury to a third party, or attempt to use our services for unlawful or wrongful purposes.
  • (7)To use information necessary for the Company to service you, such as your billing information and inquiries or requests sent to the Company, as well as your service usage and contact information, in order to respond to your inquiries or requests.
  • (8)To research and select services to provide you.
  • (9)For joint usage purposes between the Company and its affiliates and group companies.
  • (10)To provide and propose information regarding new products and services of the Company and its affiliates and group companies.
  • (11)To detect and prevent unauthorized use of credit cards, information such as your name, phone number, email address, and details about your internet usage environment may be provided to the credit card company you are using.
  • (12)For purposes incidental to the purposes of use stipulated above.
3.Provision of personally identifiable information to third parties

Unless otherwise allowed under laws and regulations such as the Act on the Protection of Personal Information, the Company shall not provide personally identifiable information to a third party without obtaining your prior consent. However, exceptions will be made in the following cases:

  • (1) When required by laws and regulations.
  • (2) When necessary for the protection of a person's life, body, or property and when it is difficult to obtain your consent.
  • (3) When crucial for improving public health or promoting the healthy development of children and when it is difficult to obtain your consent.
  • (4) When necessary to cooperate with a government organization or municipality, or an individual or entity entrusted thereby to execute a duty prescribed by laws and regulations and when obtaining your consent is likely to impede the execution of said duty.
  • (5) When the Company has notified you of or publicly announced the following:
    • ①That the purpose of use includes provision to a third party.
    • ②The type of data to be provided to third parties.
    • ③The means or method by which said data will be provided to third parties.
    • ④That the provision of personally identifiable information to third parties shall be suspended at your request.

Notwithstanding the above conditions, the following are not deemed to constitute the provision of information to a third party:

  • (1)When the Company entrusts an individual or entity to handle all or part of personally identifiable information within the scope necessary to achieve the purpose of use.
  • (2)When the personally identifiable information is provided in connection with a business succession due to a merger or other reason.
  • (3)When the personally identifiable information is shared with a specific individual or entity and when the Company notifies you in advance or makes readily accessible to you: the fact of said sharing agreement; the types of personally identifiable information that will be shared; who will have access to said information; the purpose of use for all involved parties; and the name or title of the individuals or entities responsible for managing personally identifiable information.
4.Disclosure of personally identifiable information

If you request the disclosure of personally identifiable information related to yourself that has been collected by the Company, the Company shall provide it to you without delay. However, the Company may decide not to disclose all or part of personally identifiable information if any of the following apply, in which case the Company will notify you to that effect without delay. The Company will charge a service fee of ¥1,000 (tax included) for each disclosure of personally identifiable information.

  • (1)When disclosure is likely to harm the life, body, property, or other rights and interests of you or a third party. (2) When disclosure is likely to significantly impede the proper execution of the Company’s business. (3) When disclosure would violate other laws and regulations.

Notwithstanding the conditions above, the Company does not in principle disclose records, private data, and other information not categorized as personally identifiable information.

5.Correction, deletion, and suspension of use of personally identifiable information

If any personally identifiable information that the Company holds about you is incorrect, you may request the correction or deletion of said personally identifiable information by a procedure specified by the Company.

If the Company receives from you a request as described in the preceding paragraph and deems it necessary to respond to the request, the Company will correct or delete said personally identifiable information without delay and notify you of said correction or deletion.

If the Company receives from you a request to suspend the use of or erase (hereinafter “suspend the use of”) personally identifiable information on the grounds that it was acquired through unlawful means or is being used for purposes beyond the scope of the purpose of use, the Company will investigate without delay and, on the basis of the result, suspend the use of the personally identifiable information and notify you to that effect. However, if it is difficult to suspend the use of personally identifiable information for reasons such as the high cost of doing so, and if alternative measures can be taken to protect your rights and interests, the Company will take said alternative measures.

6.Use of cookies

The Company’s online shop may display advertisements distributed by a third party such as Yahoo Japan Corporation; in this case, the third party may acquire and use cookie information pertaining to users who visit said shop.

The cookie information acquired by the third party is handled in accordance with the third party’s privacy policy. If you want to stop the third party from using your cookie information to show you advertisements, you can access an opt-out page on their website. A cookie is a file created on your computer when you access a web page. Cookies store information such as your usage history and inputs sent between your browser and a server. The next time you access the page, the website operator can use your cookie information to display information specific to you. If you enable cookies in your browser settings, the website can access your cookies via your browser. To protect your privacy, your browser will only send cookies associated with that website’s server. You can set cookie preferences in your browser to, for example, enable all cookies, block all cookies, or notify you when you receive cookies.

The specific method for setting your cookie preferences depends on your browser. Refer to your browser’s Help menu to set your cookie preferences. If you choose to block all cookies, you may be restricted from using certain online services, such as services that require authentication.

7.Securing personally identifiable information

For security purposes, the Company uses a secure sockets layer (SSL) to prevent personally identifiable information from being intercepted, tampered with, or falsified when entered into the Company website. SSL is a security protocol for encrypting information so that data can be sent and received while being protected from bugging and data falsification. The use of SSL allows the Company to transmit your information more securely.

8.Revisions to this Privacy Policy

The content of this Privacy Policy is subject to revision without notice. Unless otherwise specified by the Company, the revised Privacy Policy shall take effect as soon as it is posted on the Company website.
